This action was brought by Samuel Bailie, the plaintiff below, in the Court of Common Pleas of Lancaster county. The charge of the Court is placed on the record, and it appears to me to be correct. There is also a bill of exceptions to the opinion of the Court on the rejection of the evidence of Thomas R. Buchannan, a witness produced on the part of the defendant. Mr. Buchannan was the indorser of the note on which the suit was brought, and consequently, originally liable to an action.
