MEMORANDUM OPINION AND ORDER

BABCOCK, District Judge.

Plaintiff, Ronald J. Kirby, appeals the final decision of Michael J. Astrue, Commissioner of Social Security, denying his application for Social Security Disability benefits and Supplemental Security Income benefits. Following an October 3, 2006, hearing, Administrative Law Judge (“ALJ”) William Musseman issued an unfavorable decision on December 6, 2006.
