This is a suit to set aside a deficiency assessment of additional income taxes for the calendar year 1958. Upon a formal hearing, the State Tax Commission confirmed the additional assessment by its opinion and order No. 1-62-6 and, thereupon, the plaintiff brought this suit.

In 1958, plaintiff Robert Spr-onl, a cattle rancher, was charged with the murder of Harlan Williams in G-rant County, Oregon. Upon a trial being had in the Circuit Court for G-rant County, Robert Sproul was acquitted. During 1958, Robert Sproul paid $22,864.31 in attorneys’ fees and expenses in…
