On April 20, 1910, appellant, hereinafter called plaintiff, commenced an action of the first class in the Municipal Court of Chicago against appellee, hereinafter called defendant, to recover damages in the sum of $8,932.60, claimed to have been sustained by plaintiff in April and May, 1907, on account of the breach by defendant of an alleged written contract, dated April 17, 1907, in failing to furnish plaintiff certain refrigerator cars at Corona, Riverside county, California.
