*754In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Schneier, J.), entered April 10, 2007, which, upon an order of the same court dated May 12, 2005, granting that branch of the defendants’ motion which was, in effect, to dismiss the complaint pursuant to CPLR 3211 (a) (7), dismissed the complaint.
Ordered that the judgment is reversed, on the law, with costs, the branch of the defendants’ motion which was, in effect, to dismiss the complaint pursuant to CPLR 3211 (a) (7) is denied, the complaint is reinstated, and…
