Appeal from an order of the district court denying defendant’s motion for a new trial.

Defendant was charged by information with the crime of aiding and abetting a theft in violation of Minn. St. 609.05, subd. 1, and 609.52, subd. 2(1), on March 12, 1964, at the Plaza Piggly-Wiggly Store located at 1130 East First Street, Duluth, Minnesota. A plea of not guilty was entered. The defendant was represented at trial by a court-appointed attorney, who also represents him on this appeal.
