Appeal from an order of the Court of Claims, entered May 3, 1972, which denied a motion by the State of New York to dismiss a claim based on breach of contract. On June 23, 1967 respondent, a distributor of mineral waters, entered an agreement with appellant which, among other things, provided that respondent would purchase fixed quantities of mineral waters from the Saratoga Springs Commission1 for a period of 10 years.
