This is a suit brought by a subcontractor of a subcontractor against a primary contractor for labor done and materials furnished by plaintiff.

Appellant^ filed a declaration in two counts. The first count of the declaration alleged that the defendant entered into a construction contract with E. O. Spencer and others to build a bridge and roadway, and furnish all labor and material used in the project.
