Appeal from an order of the Municipal Court of the city of New York, borough of Manhattan, dispossessing tenants.

1Per curiam

The appellants held under a lease by which they agreed to pay their rent monthly on the fifteenth day of each month. The lease, their possession under it, the refusal to pay the rent which accrued on July 15, 1899, and a demand are all admitted. The defense is that, on June 28, 1899, the landlord *690had executed a lease of the premises to Mr. Thorn. This lease was marked in evidence, but is not attached to the return, and its terms do not appear.
