Affirming.
While working for the Sunlight Coal Company at its mines at Waverly, in Union county, Collins Floyd was severely injured as the result of an accident arising out of and in the course of his employment. On the same day, and pursuant to section 61 of the Workmen’s Compensation Act (Ky. Stats., sec. 4944), the accident was reported by the employer to the Workmen’s Compensation Board on form No. 7.
