ORDER

BATTISTI, District Judge.

Before the Court is a motion to dismiss filed by Defendant United States of America. For the reasons set forth below, it is denied.

FACTUAL BACKGROUND

This is a disappointed bidder case. Plaintiff North Shore Strapping Company, Inc. (North Shore) submitted an offer, which was rejected, for zinc coated steel strapping in response to a solicitation by agencies of Defendant United States of America. Plaintiff alleges that the Defendant Small Business Administration (SBA) exceeded its jurisdiction and acted in bad faith in determining that its offer was unacceptable.
