SMITH, Judge.

Appellant, plaintiff below, seeks reversal of summary judgment entered in favor of the appellee, one of the defendants in a medical malpractice suit. We reverse.

During the course of his duties as an Escambia County Deputy Sheriff, appellant’s husband was shot in the chest, abdomen and buttocks. Emergency surgery *730was performed at Baptist Hospital, following which Officer Streeter was placed in intensive care.
