The following statement of facts appears F the record, to wit: “This was an action com menced by D. R. Bird, plaintiff, against W. H. Sullivan, defendant, on the 17th day of December, .1898, in the court of A. M. Bridges, magistrate, on money demand of $48.86, in the county of Cherokee.
