MONROE, J.

John Moritz Wiemann, then a widower residing in New Orleans, died in the parish of St. Tammany July 1, 1894, leaving property in this city consisting in part of a going commercial business, carried on in two stores, the one on Tchoupitoulas and the other on Magazine street, and leaving also seven major and two minor children, issue of his marriage, to wit, Charles F., Thomas J., Isabella (wife of W.
