Appeal from Linn Circuit Court. The plaintiff is a lawyer, and commenced an action against the defendant for divorce. The defendant’s wife was plaintiff in the action, which was dismissed by the parties thereto. This action was brought to recover for services rendered in the divorce proceeding. Trial by jury, judgment for the plaintiff, and defendant appeals.

The amount claimed in the pleadings being less than $100, the trial judge has certified the following questions to be determined by this court; u In an action at law against a husband, on an implied promise to pay for professional services rendered for his wife in an action by her for divorce, does the necessity for such services, or the implied promise therefrom by the husband to pay for same, arise, when the verified allegations of the wife, with sufficient corroborating testimony of others, would, without conflicting testimony, entitle the wife to a divorce? or, to establish such…
