This appeal is from a judgment, after cross motions for summary judgment, for the holder of a design patent (No. 217,942) of a cigar holding ashtray. The United States District Court for the Southern District of New York, Charles H. Tenney, Judge, held for the plaintiff, Lancaster Colony Corporation (Lancaster), in its suit claiming that defendants, Aldon Accessories, Ltd. (Aldon), and Royal London, Ltd.
