This is the second appeal in this case (Link v. Harrington, 41 Mo. 635). Our opinion on the first appeal contains a full statement of the facts out of which this litigation has arisen. The judgment then as now was for the plaintiff, and it was reversed solely on the ground," that the trial court erroneously attached a clause modifying one of the plaintiff ’ s instructions.
