In an action to recover damages for personal injuries, the defendant D.G. Heuer appeals, as limited by his brief, from so much of an order of the Supreme Court, Westchester County (Donovan, J.), entered October 17, 1997, as denied his motion for summary judgment dismissing the complaint insofar as asserted against him.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the appellant’s motion for summary judgment is granted, the complaint is dismissed insofar as asserted against him, and the action against the remaining defendant is severed.
