OPINION ON SECOND MOTION FOR REHEARING

We deny appellants’ motion for rehearing, withdraw our opinion and judgment dated June 2, 2006, and substitute the following in its place.

In the 1993 Edwards Aquifer Authority Act (EAA Act), the legislature established a new regulatory scheme to govern use of groundwater from the aquifer and a new agency, appellant Edwards Aquifer Authority (the Authority), to administer the regime.
