OPINION

ODOM, Judge.

This appeal is from a conviction for the offense of unlawfully carrying a switchblade knife. The punishment was assessed at sixty days in jail.

At approximately 4:00 A.M. on August 14, 1969, Officers Aycock, Ontiveros, and Privett of the Lubbock Police Department, were returning to the police station after having answered a call in the southwestern part of that city.
