Appeal, by the defendant, The President, Managers and Company of the Delaware and Hudson Canal Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Broome on the 15th day of February, 1898, upon the verdict of a jury for $7,000, and also from an order entered in said clerk’s office on the 13th day of December, 1897, denying the defendant’s motion for a new trial made upon the minutes.

Parker, P. J.:

The plaintiff in this action seeks to recover against the defendant for a personal injury which, he claims, was caused by one of its employees negligently opening a switch and allowing an engine to back down against a car he was helping to unload. The defendant does not deny that it is liable to . respond in damages to the extent of his injuries, but it claims that the verdict which was rendered against it upon the trial was grossly excessive, and that such verdict was rendered because, of many erroneous rulings made upon the trial..
