Appeal from a judgment of the Supreme Court at Special Term, entered January 24, 1977 in Albany County, which, after converting petitioner’s article 78 proceeding into an action for declaratory judgment, declared certain Medicaid reimbursement rates void and remitted the matter to the Commissioner of Health for an evidentiary hearing. Petitioner, Charles E.
