Appeal from a judgment of the County Court of Albany County (Harris, J.), rendered June 20, 1985, convicting defendant upon his plea of guilty of the crime of sodomy in the first degree.

On March 26, 1985, defendant was indicted by an Albany County Grand Jury and charged in four separate counts with sodomy in the first degree, attempted sodomy in the first degree, attempted rape in the first degree and sexual abuse in the first degree.
