The opinion on rehearing of this Court rendered on November 10, 1983, is hereby withdrawn and the following opinion is substituted therefor.
The appeal is brought by Charles R. Milton, II, defendant and counter-plaintiff below, from the rendering of a take nothing judgment on his counter-claim. The subject matter of this appeal, appellant’s counter-claim, had been severed from the original cause in which appellant was defendant.
