Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Greene County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

While an inmate was assaulting a correction officer, another inmate encouraged a group of inmates to fight with staff who were responding to the incident. Petitioner was in the group and attempted to push open a door in an effort to reach the area and join in the altercation.
