The defendant, having been convicted upon a jury verdict of murder in the second degree (Penal Law § 125.25 [4]), moved this court for an order, pursuant to Criminal Procedure Law § 440.10 (1) (g) and (h), vacating the judgment of conviction and sentence or, in the alternative, a hearing on the matter. The defense request was premised, in large part, on the assertion that the defendant was convicted on the basis of uncorroborated evidence that is now widely disputed in the medical community.
