Appeal from a judgment of the Supreme Court (Harris, J.), rendered June 16, 1992 in Albany County, upon a verdict convicting defendant of the crime of assault in the second degree.
Defendant’s conviction of assault in the second degree arose out of an altercation at the Osborne Street Garage in the City of Albany, where defendant was employed, when he struck the victim with a baseball bat while the victim was attempting to retrieve a car that had been towed to the garage earlier *895in the evening.
