Error to the common pleas of Athens county. The action of the common pleas was ejectment, commenced *in April, 1847, against Davis and others, and was tried to a jury at the November term, 1849. The jury returned a special verdict, upon which the common pleas, “ being of opinion that the law arising upon the fact so found by the jury is with the defendants,” rendered judgment in favor of said defendants. This writ of error is prosecuted to reverse the judgment so rendered.
