HAMILTON, Circuit Judge.

This is an appeal from a judgment of the District Court dismissing petition of appellant (plaintiff below).

On December 31, 1929, the Flint Golf Club, a Michigan corporation, executed and sold to the First National Bank of Flint, Michigan, a corporation incorporated under the National Banking Act, a series of notes aggregating Sixty Thousand , ($60,000) Dollars, secured by lien on real estate.
