Cross appeals from an order of the Supreme Court (Lahtinen, J.), entered November 16, 1998 in Franklin County, which granted plaintiffs’ cross motion for partial summary judgment on the issue of liability pursuant to Labor Law § 240 (1) and partially denied defendant’s motion for summary judgment dismissing the complaint.
