Appeal from an order of the Family Court of Broome County (Connerton, J.), entered July 5, 2012, which granted petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.

Petitioner (hereinafter the father) and respondent (hereinafter the mother) are the unmarried parents of a son (born in 2006). In May 2011, Family Court, on consent of the parties, awarded sole custody of the child to the mother, with supervised parenting time to the father, and issued a one-year stay away order of protection against the father.
