This case originated in the county court of Osage county, Oklahoma, an administrator having been appointed in the matter of the estate of David W. Tinker, deceased. By decree of the county court the defendants in error herein were declared to be the sole and only heirs of David W. Tinker, deceased. Prom this judgment in the county court an appeal was taken in the cause to the district court, in which the plaintiffs in error, Charles Tinker and Lela B.
