Appeal from the circuit court of. Forest county. Hon. Paul B. Johnson, Judge._ Suit by state of Mississippi against the New Orleans, Mobile & Chicago Bailroad Company. From a judgment for plaintiff, defendant, appeals. The facts are fully stated in the opinion of the court.

delivered the opinion of the court.. The state, through Boss A. Collins, Attorney-General, and D. L. Thompson, Auditor of Public Accounts, brought this action of debt against appellant, a railroad company incorporated under the laws of Mississippi and operating a line of railroad from Mobile in the state of Alabama, through Mississippi, and to Middleton, Tennessee, to recover the privilege taxes for the year 1914, imposed by chapter 102, Laws of 1912, amending section 3856, ch. 114, of the Code of 1906'.
