SAFFELS, District Judge.
This case comes before the Court for determination of defendants’ motion to dismiss for failure to state a claim upon which relief may be granted and lack of subject matter jurisdiction. This case is a civil rights action brought under 42 U.S.C. §§ 1983, 1985, 1986 and 1988; the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 701, et seq.; and the First, Fifth, Ninth and Fourteenth Amendments to the United States Constitution.
