This is an action of replevin, begun in the circuit court of Marion county, for the recovery of a sawmill and outfit. The petition was in the usual form. The answer of the defendant denied the allegations of the petition, and averred that he was the owner and entitled to the possession of the property in dispute, and demanded the return thereof. There was a verdict and judgment for defendant, from which plaintiff has appealed to this court.
