Appellant was charged in the court below, by information filed March 28, 1932, of the crime of murder in the first degree, as follows:

“He, said Ted Bradley alias George Everette Slate, in the county of King, state of Washington, on or about the 17th day of March, A. D. 1932, while then and there wilfully, unlawfully and feloniously engaged in committing, attempting to commit and withdrawing from the scene of the commission of a felony, to-wit: Robbery of one G.
