On November 22, 1907, an information was filed in the municipal court of Chicago whereby that court was informed that the plaintiff in error, D. W. Hoban, on said day “did unlawfully steal, take and carry away, with intent to steal, some forty stamped envelopes, valued at one dollar ($1), property of the Barrett Manufacturing Company, a corporation organized under the laws of West Virginia.” The next day the defendant was arraigned and pleaded not guilty.
