MEMORANDUM OPINION AND ORDER

PESQUERA, District Judge.

Brigadier General Roberto R. Vargas, Assistant Adjutant General for the Air of the Puerto Rico National Guard and a National Guard Technician, filed this suit on September 4, 1975 for injunctive relief with respect to defendant’s action terminating his employment as National Guard Technician.
