This is an action against the defendant City of New York by plaintiff wife to recover damages for personal injuries and by her husband, in a derivative action, to recover for medical services and expenses. There was a jury verdict in favor of the plaintiff wife but against the plaintiff husband. The plaintiff husband moved to set aside the verdict disallowing any recovery in the derivative action.
