HIGGINS, District Judge.

The Court has before it the defendant’s supplemental memorandum in support of his motion to dismiss (filed January 20, 1999; Docket Entry No. 75), which the Court will treat as a motion to reconsider its decision on December 8, 1998, to deny the defendant’s motion (filed December 4, 1998; Docket Entry No. 60) to dismiss.1 On January 22, 1999, the government filed a response (Docket Entry No. 76) to the supplemental memorandum, stating that it was relying on the reasons set forth in its initial response of December 8, 1998.
