In the year 1892 the plaintiff was thp owner and in the possession •of a lot of land situated bn One Hundred and Eighty-fourth street, near the point where that street intersects Bainbridge avenue. It became necessary to fix the grade of the street in front of the plaintiff’s premises,, and it was established at a height of about twenty-two feet above the surface of the ground along the front of the plaintiff’s lot.
