Statement of the Case

On March 10, 1980 the minor child of Betty Nahrwold was taken into custody by the Department of Public Welfare of Allen County. On March 11, 1980 the Department filed a request for the filing of a *476formal petition and for taking custody of the child. A hearing was held on March 12, 1980 before Robert Schmoll, Referee of the Family Relations Division of Allen Superior Court.
