The judgment of the court (Post, J. absent,) was pronounced by

The plaintiff, who brought his action in December, 1847, alleges that; in the summer of 1847, a raft which belonged to him, and was in cours'e of transportation dowh the Mississippi, was stranded upon the land of the defendant, and was afterwards appropriated by the defendant to his own use. Damages Were claimed to the amount of $490. The! defendant pleaded the general issue. There was judgment in favor of the plaintiff for $300, and the defendant has appealed.
