SEXTON, Judge.
After his home was damaged by fire, plaintiff, W.P. Sevier,1 instituted this action to recover certain proceeds from a homeowner’s policy containing the statutorily provided fire requirements. During the course of this litigation, defendant filed |certain exceptions, including an exception ¡¡of prematurity, alleging that plaintiff had not complied with the requirements of the insurance policy prior to institution of this suit.
