On September 12, 1952, plaintiff was tbe holder of a class “B” beer permit issued by tbe City of Clinton. On that date the city council, by a six to three majority, voted to revoke tbe permit. Thereupon tbe plaintiff brought bis action of certiorari challenging the legality of the action of the council and alleging that it acted arbitrarily and without jurisdiction. After hearing, the trial court sustained the writ.
