GAINES, Chief Justice.
—This controversy arose in the County Court of Henderson County during the course of a proceeding for the partition and distribution of the estate of N. P. Coleman, deceased. Coleman died intestate, and defendant in error, Morrison, became the administrator of his estate. He left surviving him a widow and five children. One' of the intestate’s children died before his father, leaving a minor son, who is the plaintiff in error in this court.
