Appeal from an order made at Special Term denying a motion made by the plaintiff to compel the purchaser to complete his purchase, by talcing the title tendered to him under' a foreclosure sale and paying the balance of the purchase-price.

The mortgage which was foreclosed' was executed by Sophia. Tffla. as trustees under the will of Martin Fichen, her deceased husband. She was appointed the trustee of all his real estate by his will, which was executed on the 22d of October, in the year 1851, and he died in the year 1853.
