In an action to recover damages for personal injuries, the third-party defendant appeals from (1) an order of the Supreme Court, Kings County (Duberstein, J.), dated February 9, 1987, which denied its motion pursuant to CPLR 3211 (a) (5) to dismiss the third-*353party complaint, and (2) an order of the same court, dated April 24, 1987, which denied its motion for summary judgment and for the imposition of costs and attorney’s fees pursuant to CPLR 8303-a.
