Alsing Company, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Kings on the 7th day of March, 1900, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 6th day of March, 1900, denying the plaintiff’s motion for a new trial made upon the minutes. The appellant relies upon four grounds for reversing the judgment, the principal one of which is that there was error in the exclusion of the evidence offered to show that the defendant had not complied with section 15 of chapter 687 of the Laws of 1892, The' plaintiff presented evidence which, if admitted, would have tended to prove that the defendant corporation doing business in the State of New York had not procured the certificate required by section 15, chapter 687 of the Laws of 1892, and by chapter 240 of the Laws of 1895.
