GALSTON, District Judge.

This suit, brought pursuant to Longshoremen’s and Harbor Workers’ Compensation Act, § 21(b), 33 U.S.Code, § 921(b), 33 U.S.C.A. § 921(b) seeks to enjoin the defendants from enforcing an award made by the Deputy Commissioner of the United States Employees’ Compensation Commission and to set aside the award on the grortnd that the injury to Francesco Vascone, resulting in his death, was not sustained in nor did it arise out of the course of his employment.
